FCC Releases Second Report & Order and FNPRM on WRS

In the August Open Meeting, the Commission adopted a Second Report and Order and Further Notice of Proposed Rulemaking (“Second Report and Order” or “Second FNPRM”) that implements a unified regulatory framework for Wireless Radio Services (“WRS”) that “replaces the existing patchwork of service-specific rules regarding renewal, comparative renewal, continuity of service, and partitioning and disaggregation performance, with clear, consistent rules of the road for WRS licensees.”  Specifically, the Second Report and Order establishes a uniform renewal standard for wireless licenses, and a safe harbor based on licensee certifications to reduce filing burdens and expedite Commission review.  The Second FNPRM seeks additional comment on potential construction obligations beyond the initial license term, and potential penalties and remedies for licensees that fail to meet buildout requirements, among other proposals.

The rules adopted in the Second Report and Order will become effective 30 days after publication in the Federal Register, unless they contain new or modified information collection requirements which will become effective after OMB review and approval, which will also be published in the Federal Register.
