FCC Releases Public Notice Updating Tower Construction Notification & E-106 Systems

On July 2, 2018, the Federal Communications Commission (“FCC” or “Commission”) released a Public Notice (the “Notice”) (DA 18-675) detailing changes and updates to the Tower Construction Notification System (“TCNS”) and Electronic Section-106 System (“E-106”) to implement the FCC’s 2018 Infrastructure Second Report and Order (“Order”). Effective July 2, 2018, TCNS has stopped accepting new submissions and E-106 will stop accepting submissions at 6:00am EST on Friday, July 6, 2018. Both systems will resume accepting new submissions at 10:00am EDT on Friday, July 6, 2018. Applications filed in TCNS or E-106 will be processed under the rules in place as of the filing date and the changes outlined in the Notice will apply only to filings submitted on or after July 2, 2018. Pending applications may be abandoned and then resubmitted on or after July 2, 2018, which would then fall under the changes outlined in the Notice. Applicants who resubmit a filing are encouraged to note that the application has been refiled and include the earlier notification number in the new submission. The Commission will extend Tribal response deadlines that fall between July 2 – July 5, 2018 until July 6, 2018.
