FCC Adopts Spectrum Frontiers Fourth Report and Order

On December 12, 2018, in the December Open Meeting, the Commission adopted the Fourth Report and Order in the Spectrum Frontiers proceeding (GN Docket No. 14-177). The Order adopts an incentive auction mechanism that will offer contiguous blocks of spectrum throughout the Upper 37 GHz (37.6-38.6 GHz), 39 GHz (38.6-40 GHz), and 47 GHz (47.2-48.2 GHz) bands and also develops a new band plan and service rules for these above-24 GHz bands. The Commission aims to auction these bands by the end of 2019 and offer a total of 3,400 MHz (2, 400 MHz of Upper 37 GHz and 39 GHz and 1,000 MHz of 47 GHz) of spectrum for millimeter wave (“mmW”) services. The Commission intends to seek additional comment on auction details through an Auction Comment Public Notice.

The adopted item contained very few changes from the released draft version of the item. Notably, the adopted item clarified that the item does not contain new or modified requirements that would require OMB approval, and therefore the adopted item in its entirety will become effective 30 days after publication in the Federal Register.
