On Friday, December 27, 2019, the Consumer and Governmental Affairs Bureau (“Bureau”) released a Public Notice seeking comment on a Petition for Declaratory Ruling (“Petition”) filed by Lucas Cranor in the Rules and Regulations Implementing the Telephone Consumer Protection Act (“TCPA”) proceeding (CG Docket No. 02-278).
The Petition seeks a ruling that “consumers have the right to revoke consent from receiving unwanted marketing text messages from their wireless providers at any time by any reasonable means; and that wireless providers must honor these revocation requests immediately.” The Petition argues that even though cellular carriers are not required to obtain consent from their subscribers prior to initiating autodialed calls or text for which the subscriber is not charged, they must still honor requests to opt out of such communications. The Bureau seeks comment on this and other issues raised in the Petition.
Comments on the Petition are due January 27, 2020.
Reply comments are due February 11, 2020.
