On Wednesday, February 26, 2020, the Public Safety and Homeland Security Bureau (“Bureau”) released a Public Notice (“Notice”) announcing the opposition and reply deadlines to a Petition for Reconsideration (“Petition”) filed by the Boulder Emergency Telephone Service Authority (“BRETSA”) to the Fifth Report and Order (“Order”) in the Wireless E911 Location Accuracy (“Z-Axis”) proceeding (PS Docket No. 07-114).
The Petition asks the Commission to reconsider two aspects of the Order.
- BRETSA asks the Commission to reconsider its decision to reject proof-of-performance testing in favor of the testbed approach for determining whether wireless providers are meeting the vertical location accuracy standard, arguing it was both arbitrary and capricious and an abuse of discretion to decline proof of performance testing at limited locations.
- The Petition asks the Commission to consider BRETSA’s previous proposal to require wireless providers to actively participate with and publish procedures for First Responders to conduct tests of vertical location accuracy and provide any required assistance in such tests, specifically to local governments and public safety agencies.
As a reminder, the rules adopted in the Order will take effect on March 16, 2020.
Oppositions will be due 15 days after publication of this Notice in the Federal Register.
Replies to oppositions will be due 25 days after publication in the Federal Register, i.e., 10 days after the time for filing oppositions has expired.
