FCC Releases Order Denying PSSI’s Stay Petition in C-band Proceeding

On July 8, 2020, the Wireless Telecommunications Bureau (“Bureau”) released an Order denying PSSI Global Services, L.L.C. (“PSSI”)’s request for stay of the C-band Report and Order (“Report and Order”) (GN Docket No. 18-122). This is the second request for a stay of the Report and Order that has been denied.

 

The Bureau found that PSSI did not meet its burden to show that it would suffer irreparable harm absent grant of the stay because PSSI’s alleged injuries were speculative and PSSI failed to identify an instance in which it was unable to obtain needed satellite capacity for its services. The Bureau also found that PSSI’s three merits arguments were unlikely to succeed.
