FCC Publishes Rip and Replace Order in Federal Register

On January 13, 2021, the FCC published in the Federal Register the Report and Order (the “Order”) implementing the Secure and Trusted Communications Networks Act of 2019 (“Secure Networks Act”) thereby establishing an effective date for several provisions in the order.  The effective date for the Order is March 15, 2021, except for three amendatory instructions, for which the effective date is delayed indefinitely.  A summary of the Order is included below.

The effective date for the following provisions has been delayed indefinitely:

  • Instruction 3: Sections 1.50004(c), (d)1, (g), (h)(2), and (j) through (n) Secure and Trusted Communications Networks Reimbursement Program setting forth the application requirements, funding disbursement requirements, disposal requirements, and reporting requirements, among others;
  • Instruction 5: Section 1.50007 Reports on Covered Communications Equipment or Services setting for the reporting requirements for the program; and
  • Instruction 7:  Section 54.11 Requirement to Remove and Replace setting forth the requirements to remove non-qualifying equipment from a provider’s networks to receive USF funding.

The FCC will publish a future notice in the Federal Register announcing the effective dates of these instructions after it receives OMB approval.
