June 29, 2022 Weekly Wireless Wrap-Up

Good afternoon from Washington, DC!  Below you will find our Weekly Wireless Wrap-Up, your update on the wireless telecommunications regulatory landscape, important wireless decisions, and more!  Here is your wrap-up:

FCC:

  • Last Wednesday, the Consumer and Governmental Affairs Bureau (“CGB”) released a Public Notice seeking comment on its tentative findings on the accessibility and usability of telecommunications and advanced communications services in connection with the 2022 Biennial Report. The report must be submitted to Congress by October 8, 2022 and provide an assessment of industry compliance with the disability accessibility provisions of the Communications Act of 1934, as amended.  Comments on the CGB’s tentative findings are due August 8, 2022.  For more information and to view a copy of the Notice, see our post here.
  • Last Thursday, the FCC published in the Federal Register the Notice of Proposed Rulemaking (“NPRM”) seeking comment on the broadband transparency rules governing the annual collection of information about the price and subscription rates of internet service offerings received by households enrolled in the Affordable Connectivity Program (“ACP”), thereby setting the comment and reply comment dates. Comments are due July 25, 2022 and reply comments are due August 8, 2022.  For more information and to view a copy of the Notice, see our post here.
  • Also last Thursday, the FCC released the Tentative Agenda for the July Open Meeting, scheduled for July 14, 2022 at 10:30 AM. The Commission is tentatively scheduled to consider six items, including a Report and Order and Second Further Notice of Proposed Rulemaking on the Enhanced Competition Incentive Program.  The public can view the meeting in person at the FCC’s headquarters or online at fcc.gov/live or the FCC’s YouTube channel.  For more information and to view a copy of the Agenda, see our post here.
  • On Monday, the FCC published in the Federal Register the Notice of Inquiry (“NOI”) seeking comment on facilitating access to spectrum for offshore uses and operations, thereby setting the comment and reply comment dates. Comments are due July 27, 2022 and reply comments are due August 26, 2022.  For more information and to view a copy of the Notice, see our post here.
  • Finally, over the past few weeks, the FCC has released several items related to the Broadband Data Collection (“BDC”) in preparation for the approaching inaugural filing window, including: an Enforcement Advisory reminding providers of their obligation to file in the BDC; a Public Notice announcing that the production version of the Broadband Serviceable Location Fabric is now available; and a Public Notice announcing that fixed and mobile broadband providers can obtain early access to the BDC filing system to register and become familiar with certain parts of the system. As a reminder, the inaugural BDC filing window opens tomorrow, June 30, 2022, and providers are required to submit complete and accurate data as of June 30, 2022 by September 1, 2022.  For more information and to view copies of the items, see our post here.
