FCC Waives Tribal Window Specific Interim and Final Performance Deadlines

On July 8, 2022, the Wireless Telecommunications Bureau (“Bureau”) released a Public Notice announcing that it was waiving the 2.5 GHz rural Tribal Window specific interim and final performance deadlines.  The Bureau found good cause to waive the requirements, noting that applying the strict standards of the Window would be inequitable and contrary to the purpose of the Window, particularly given challenges from the COVID-19 pandemic and the long-standing connectivity challenges facing Tribal Nations.

Tribal Window licensees will instead be subject to the performance deadlines for all other 2.5 GHz licensees initially granted after October 25, 2019, as set forth in sections 27.14(u)(2) and (3) of the FCC’s rules.  Pursuant to this rule, Tribal Window licensees will be required to make an interim showing within 4 years of initial license grant and a final showing within 8 years of initial license grant, although they need not wait until the relevant deadlines approach to make their filings.  Tribal Window licensees are encouraged to submit their interim and final showings once the work has been completed.
