FCC Publishes Broadband Consumer Label Rules in Fed. Reg.

On December 16, 2022, the FCC published in the Federal Register the Report and Order and Further Notice of Proposed Rulemaking (“FNPRM”) adopting rules for a new broadband consumer label and seeking comment on further steps the FCC can take to ensure that consumers have the information they need to make informed broadband service purchasing decisions.

The Report and Order is effective January 17, 2023.  However, the effective date for all of the adopted substantive rules, including the label contents, creation, and reporting requirements (47 C.F.R. 8.1(a)(1)-(6)), is delayed indefinitely to obtain OMB approval.  A future Notice announcing OMB approval and the effective date of the adopted rules will be published in the Federal Register.

Comments on the FNPRM are due on or before January 17, 2023.

Reply comments on the FNPRM are due on or before February 14, 2023.
