January 12, 2023 Weekly Wireless Wrap-Up

Good afternoon from Washington, DC!  Below you will find this week’s Wireless Wrap-Up, your update on the wireless telecommunications regulatory landscape, important wireless decisions, and more!  Here is your wrap-up:

  • JANUARY OPEN MEETING
    • On 1/5, the FCC released the Tentative Agenda for the January Open Meeting, scheduled for January 26, 2023 at 10:30 AM. The Commission is tentatively scheduled to consider four items, including a Notice of Proposed Rulemaking on 988 Reliability and Resiliency.  For more information, and to view a copy of the Tentative Agenda, see our post here.
  • BROADBAND CONSUMER LABELS
    • On 1/4, the Consumer and Governmental Affairs Bureau released an Order granting a 30 day extension of the comment and reply comment deadlines for the Commission’s Further Notice of Proposed Rulemaking on Broadband Consumer Labels. Comments are now due February 16, 2023 and reply comments are now due March 16, 2023.  For more information, and to view a copy of the Order, see our post here.
  • UNMANNED AIRCRAFT
    • On 1/4, the FCC released a Notice of Proposed Rulemaking (“NPRM”) seeking comment on three proposals to promote unmanned aircraft access to licensed spectrum. For more information and to view a copy of the NPRM, see our post here.
  • DATA BREACHES
    • On 1/6, the FCC released a Notice of Proposed Rulemaking (“NPRM”) seeking comment on proposals to modernize the FCC’s CPNI data breach rules. The NPRM seeks comment on three main changes to the CPNI breach rules.  For more information, and to view a copy of the NPRM, see our post here.
  • FAA AND C-BAND DEPLOYMENTS
    • On 1/11, the FAA published in the Federal Register a Notice of Proposed Rulemaking seeking comment on a new Airworthiness Directive that would apply to airplanes equipped with radio altimeters. The Airworthiness Directive would revise the airline/aircraft flight manual to incorporate limitations prohibiting certain operations requiring radio altimeter data due to 5G C-Band interference and require modifications to certain aircraft to ensure safe operations in the United States.  For more information, see the Notice here.
  • BEAD FUNDING AND BROADBAND MAPPING
    • NTIA has recommended that all challenges to the FCC’s Broadband Data Map be submitted by Friday, January 13, 2023 for the best chance of having corrections included in the version of the map that will be used to determine BEAD budget allocations. Though several states have asked for an extension of this deadline due to the number of corrections that need to be incorporated, at this time, no such extension has been granted.  NTIA is planning to announce BEAD allocations by June 30, 2023.  For more information on how to submit challenges, see our post here.
