FCC Releases NPRM on 988 Outage Reporting

On January 27, 2023, the FCC released the Notice of Proposed Rulemaking (“NPRM”) seeking comment on 988 outage reporting rules, which was adopted at the January Open Meeting.

The NPRM seeks comment on several proposals that could potentially affect wireless providers, including:

  • Whether there are additional entities that provide services or functionalities within the 988 call pathway that should be included in the definition of a covered 988 service provider
  • Whether outages affecting covered 988 texts should be reported, and if they should be reported what thresholds should apply
  • Whether cable, satellite, wireless, wireline, and interconnected VoIP providers should be required to notify 988 special facilities of outages
  • If notification is required for cable, satellite, wireless, wireline, and interconnected VoIP providers, should the form of notification be different for these providers

Comments will be due 30 days after publication in the Federal Register.

Reply comments will be due 60 days after publication in the Federal Register.
