FCC Publishes Order Prohibiting Equipment Authorizations for Covered Equipment in Fed. Reg.

On February 6, 2023, the FCC published in the Federal Register the Report and Order amending the FCC’s equipment authorization rules to prohibit authorization of equipment that has been identified on the FCC’s Covered List as posing an unacceptable risk to national security of the United States or the security or safety of United States persons, and to prohibit the marketing and importation of such equipment in the United States.

The Report and Order is effective today, February 6, 2023.  This includes provisions that the FCC preliminary concluded would need OMB approval.  The FCC waived the standard public comment period for these provisions and received emergency OMB approval of the new proposed collections.  Thus, the provisions that required OMB approval are effective today as well.
