On March 23, 2023, the FCC published in the Federal Register the Order on Reconsideration, Second Report and Order, Order, and Second Further Notice of Proposed Rulemaking on the Rural Health Care (“RHC”) Program.
The Report and Order is effective April 24, 2023, except for the following provisions which are delayed indefinitely to obtain OMB approval:
- 54.604 (amendatory instruction 2), which modified the methodology for determining the urban rate;
- 54.605 (amendatory instruction 3), which modified the methodology for determining the rural rate; and
- 54.627 (amendatory instruction 8), which modified the invoicing process certification requirements to include a certification regarding the accuracy of the invoice.
The Commission will announce the effective date of these provisions in a future notice published in the Federal Register.
Comments on the FNPRM are due on or before April 24, 2023.
Reply comments are due on or before May 22, 2023.
