Notice of Petition for Reconsideration Regarding 911 Outage Reporting

On May 31, 2023, the FCC released a Public Notice announcing that a Petition for Reconsideration was filed on March 17, 2023 by the Competitive Carriers Association (“CCA”) requesting reconsideration in part of the Second Report and Order (FCC No. 22-88) regarding 911 outage reporting.

In the Petition, CCA urges the Commission to reconsider its refusal to apply its new 30-minute deadline for initial notifications to PSAPS about outages flexibly.  CCA encourages the FCC to retain its “as soon as possible requirement” or at a minimum, start the 30-minute timer when notification occurs from an originating service provider (“OSP”) vendor or other underlying provider.  CCA also asks the Commission to reconsider its requirement that carriers, as OSPs, “gather and maintain up to date contact information for the 911 special facilities in areas they serve” and “use special diligence” in doing so. CCA argues that the FCC materially erred in determining the costs of this requirement and failed to fully consider arguments on this issue.  CCA suggests that in the alternative, the FCC should create and maintain a centralized database with information provided by 911 special facilities.

Oppositions to Petitions for Reconsideration must be filed within 15 days of the date of publication of this Public Notice in the Federal Register.  Replies to an Opposition must be filed within 10 days after the time for filing Oppositions has expired.  We will alert you once the Petition is published in the Federal Register.
