FCC Publishes Robotext R&O/FNPRM/Waiver Order in Fed. Reg.

On January 26, 2024, the FCC published in the Federal Register the Second Report and Order, Waiver Order in CG Docket No. 17-59, and Second Further Notice of Proposed Rulemaking in GC Docket Nos. 02-278 and 21-402 (“Second R&O,” “Waiver Order,” and “Second FNPRM,” respectively) on combatting illegal robotexts.

The Second R&O and Waiver Order are effective March 26, 2024, except for the following amendments:

  • 47 C.F.R. § 64.1200(s), which requires terminating mobile wireless providers, upon receipt of a Notification of Illegal Texts from the Commission’s Enforcement Bureau, to block texts from the numbers identified in the Notification, or otherwise notify the Bureau that the identified numbers have been reassigned.  This provision is effective July 24, 2024.
  • 47 C.F.R. § 64.1200(f)(9), which amends the definition of “prior written express consent” to clarify that the consent applies to one identified seller and to include the logically and topically associated requirement.  This provision is effective January 27, 2025.

Comments on the Second FNPRM are due on or before February 26, 2024.

Reply comments on the Second FNPRM are due on or before March 11, 2024.
