On January 25, 2024, the FCC published in the Federal Register notice that it had received OMB approval for certain rules and rule amendments that were adopted in the Sixth STIR/SHAKEN Report and Order (extending STIR/SHAKEN to intermediate providers) and Seventh STIR/SHAKEN Report and Order (which extended the gateway provider blocking and mitigation requirements to all carriers in the call path).
The following provisions are effective February 26, 2024:
- Section 64.6303(c) (instruction 9), which requires non-gateway intermediate providers receiving a call directly from an originating provider, not later than December 31, 2023, to either: (1) fully implement STIR/SHAKEN in its network; or (2) participate in industry groups working to develop a non-IP caller ID authentication solution. This rule was adopted in the Sixth Report and Order, which established December 31, 2023 as the compliance date.
- Section 64.6305(d), (e), and (f) (instruction 12), which updates the robocall mitigation certification and database filing requirements consistent with the new requirements adopted in the Sixth Report and Order.
- Section 64.6305(g), adopted in the Sixth Report and Order, is also effective as of this date, but compliance is not required until May 24, 2024. This rule requires that intermediate providers and voice service providers may only accept calls directly from a non-gateway intermediate provider if that non-gateway intermediate provider’s filing appears in the Robocall Mitigation database.
- Amendments to sections 64.6305(d)(2)(ii) and (iii), (e)(2)(ii), and (f)(2)(iii) (instruction 5), which amend the certification requirements for gateway providers in accordance with the new rules adopted in the Seventh Report and Order.
