On July 5, 2024, the FCC released an Order granting in part a Petition for Waiver filed by CTIA, CCA, and NCTA (collectively “Petitioners”) and waiving the compliance deadline for all rules adopted in the SIM Swap and Port-Out Fraud Order until OMB completes its review. Thus, compliance with the SIM Swap and Port-Out rules in their entirety, including those not subject to the PRA with an original compliance date of July 8, 2024, will not be required until OMB completes review of the information collection requirements associated with the Order, and the Commission publishes a notice in the Federal Register announcing the compliance date. In short, all compliance with the rules adopted in this Order will only take effect upon OMB approval.
The FCC also notes that the initial 60-day PRA public comment period commenced on June 25, 2024, and is the first of two PRA public comment periods. Additionally, the FCC explains that “providers can reasonably assume that the new rules would be under OMB review for six-to-nine months, and that OMB approval would come, at the earliest, in late November 2024.” The FCC encourages providers to “conservatively use this date as a date certain from which to base their implementation and testing of systems to implement the requirements of the SIM Swap and Port-Out Fraud Order.”
The FCC declines Petitioners’ request to waive compliance until March 10, 2025, finding that such an extension is not in the public interest.
