On November 19, 2024, the Public Safety and Homeland Security Bureau (“Bureau”) released a Public Notice outlining guidance on the implementation of rules for the Next Generation 911 (“NG911”) transition. These rules, effective November 25, 2024, were adopted in the Report and Order to advance the nationwide transition to NG911.
The Notice confirms that the following rules are not yet effective as they are subject to review and approval by the Office of Management and Budget (“OMB”):
- Authorizing 911 Authorities to make Phase 1 and Phase 2 valid requests to Originating Service Providers (“OSPs”), for delivery of 911 traffic in IP-based formats.
- Establishing a framework for OSPs to challenge the validity of Phase 1 and Phase 2 requests and to modify certain NG911 requirements through mutual agreement.
The Bureau notes that it initiated the OMB review process, and “strongly encourages” voluntary collaboration among 911 Authorities, OSPs, and other stakeholders regarding planning and implementation of key steps in the NG911 transition. The Bureau also encourages parties to develop methods, processes, and best practices that will facilitate consensual OSP responses to 911 Authorities’ voluntary requests.
Upon OMB approval, the Bureau will:
- Announce the approval and compliance date in the Federal Register;
- Release a Public Notice with additional compliance guidance;
- Provide an OMB-approved form for submitting valid Phase 1 and Phase 2 requests; and
- Open a new docket for submitting valid request forms to the Commission’s centralized registry.
