FCC Announces Protective Order Governing DoD Information Related to Auction 110

On August 20, 2021, the Office of Economics and Analytics (“OEA”) and the Wireless Telecommunications Bureau (“WTB”) released a Public Notice announcing the release of a Protective Order that provides access to Controlled Unclassified Information (“CUI”) about Department of Defense (“DoD”) systems and operations in the 3.45-3.55 GHz band, relevant for certain flexible use licenses that will be offered in Auction 110.  Access to the DoD’s CUI is limited to US citizens acting on behalf of a person or entity that: 1) has filed an application to participate in Auction 110; and 2) has selected one or more license areas that overlap with coordination areas in its application.  Individuals seeking access to the CUI will be required to execute a copy of the Protective Order affirming their eligibility to access the information, acknowledging receipt and understanding of the Protective Order, and agreeing to comply with its terms.
