On Friday, May 15, 2020, a Petition for Stay of Report and Order (“Petition”) was filed by ABS Global Ltd., Empresa Argentina de Soluciones Satelitales S.A., Hispamar Satélites S.A. and Hispasat S.A. (the “Small Satellite Operators” or “SSOs”) in the C-Band proceeding (GN Docket No. 18-122).
The Petition requests that the Commission stay the Report and Order adopted in the C-Band proceeding until the United States Court of Appeals for the D.C. Circuit has reviewed the SSO’s challenge. The SSOs state that they will succeed in Court and the Commission should grant the stay while the case is pending before the D.C. Circuit to prevent “irreparable” harm to the SSOs. The SSOs also request that the Commission act on the Petition by May 25, 2020. Otherwise, the SSOs will treat the Commission’s inaction as denial and seek relief from the D.C. Circuit.
