FCC Establishes LBR Compliance Dates

On March 13, 2024, the FCC published in the Federal Register the Report and Order (“R&O”) adopting rules requiring Commercial Mobile Radio Service (“CMRS”) providers to deploy location-based routing (“LBR”) technology to route IP-originated wireless 911 calls and real-time-text (“RTT”) communications to the appropriate public safety answering point (“PSAP”).  .

The R&O is effective May 13, 2024.  Compliance with the rules is required as follows:

  • Location Based Routing of 911 CallsNon-nationwide CMRS providers are required to deploy LBR technology on their IP networks and begin routing calls to 911 using such LBR technology by May 13, 2026.   Nationwide CMRS providers are required to deploy LBR technology on their IP networks and begin routing calls to 911 using such LBR technology by November 13, 2024.
  • Location Based Routing of RTT CommunicationsAll CMRS providers are required to deploy LBR technology in their IP networks and begin routing RTT communications to 911 using such technology by May 13, 2026.
  • Recordkeeping Requirements – Compliance with the reporting requirements in 47 C.F.R. § 9.10(s)(4), which requires CMRS providers to certify they are in compliance with the LBR requirements, and 47 C.F.R. § 9.10(s)(5), which allows CMRS providers modify the LBR deployment deadline with the consent of the local PSAP and requires the CMRS provider to file notice of such modification with the FCC, are delayed indefinitely to obtain OMB approval.   The compliance date for these provisions will be published in a future Federal Register publication.

The Public Safety and Homeland Security Bureau also released a Public Notice announcing the effective and compliance dates.
