FCC Publishes 70/80/90 GHz R&O and FNPRM in Fed. Reg.

On April 29, 2024, the FCC published in the Federal Register the Report and Order and Further Notice of Proposed Rulemaking (“R&O” and “FNPRM” respectively) adopting new rules and updating existing ones that govern the 71–76 GHz, 81–86 GHz, 92–94 GHz, and 94.1–95 GHz bands (collectively, the “70/80/90 GHz bands”) and seeking comment on accommodating additional services in the bands.

The R&O is effective May 29, 2024, except for the following provisions:

  • The addition of § 101.147(z)(3), the channel plan for the 70 and 80 GHz bands, which is effective September 1, 2024.
  • The amendment to § 101.63(b), Period of construction; certification of completed construction, is delayed indefinitely.
  • The amendment to § 101.1523(a) and (e), Sharing and coordination among non-government licensees and between non-government and government services, is delayed indefinitely.
  • The amendment to § 101.1528(a)(11), (b)(10), and (d), Requirements for aeronautical and maritime links to, from, or between endpoints in motion, is delayed indefinitely.

The FCC will announce the effective date of the delayed provisions in a future Federal Register publication.

Comments on the FNPRM are due on or before May 29, 2024.

Reply comments on the FNPRM are due on or before June 28, 2024.

PRA comments on the FNPRM are due on or before June 28, 2024.
