January 26, 2023 Weekly Wireless Wrap-Up

Good afternoon from Washington, DC!  Below you will find this week’s Wireless Wrap-Up, your update on the wireless telecommunications regulatory landscape, important wireless decisions, and more!  Here is your wrap-up:

  • 9 GHZ BAND
    • On 1/18, the FCC released a Seventh Report and Order and Ninth Further Notice of Proposed Rulemaking (the “Item”) on the 4.9 GHz (4940-4990 MHz) band. The Item retains the band’s public safety allocation, while also allowing for secondary non-public safety use of the band.  For more information and to view a copy of the Item, see our post here.
  • JANUARY OPEN MEETING AGENDA
    • On 1/19, the FCC released the Agenda for the January Open Meeting scheduled for tomorrow, January 26, 2023 at 10:30 AM. The Commission was scheduled to consider four items, however, the adjudicatory and enforcement items were adopted prior to the meeting and deleted from the Agenda.  For more information and to view a copy of the Agenda, see our post here.
  • DIGITAL DISCRIMINATION
    • On 1/20, the FCC published in the Federal Register the Notice of Proposed Rulemaking seeking comment on proposals to address digital discrimination of access to broadband internet access service. Comments are due by February 21, 2023, and replies are due by March 21, 2023.  For more information and to view a copy of the Notice, see our post
  • TCPA EXEMPTIONS
    • On 1/20, the FCC published in the Federal Register the 2020 TCPA exemption Order and the Order on Reconsidering and Declaratory Ruling clarifying two of the TCPA rules adopted in the 2020 Exemption Order.   • DATA BREACH RULES
    • On 1/23, the FCC published in the Federal Register the Notice of Proposed Rulemaking seeking comment on proposals to modernize the FCC’s data breach rules with regard to CPNI. Comments are due by February 22, 2023 and reply comments are due March 24, 2023.  For more information and to view a copy of the Notice, see our post
  • ROBOCALLS
    • On 1/24, the Enforcement Bureau released a Public Notice notifying all US-based voice service providers that they must take steps to effectively mitigate apparently illegal robocall traffic from PhoneBurner and MV Realty made to homeowners with numbers on the Do Not Call Registry.
